“What is the basis for getting a divorce; do we have to blame one another?”
Under the current law, couples who have not lived apart for at least two years can only divorce if one bases their application on the adultery or unreasonable behaviour of the other. This can escalate animosity at an already difficult time.
However, from 6 April 2022, couples will no longer have to apportion blame. They can simply file a statement of irretrievable breakdown of marriage, followed by a minimum period of 6 months (in which they can resolve financial issues and children arrangements) before applying for a Final Divorce Order.
